Welcome to Dailys, online time and expense tracking, project management and billing software developed by T&D Creative Studio (hereinafter T&D). Below are the Terms of Service explaining our obligations as a service provider and Your obligations as a customer. Please read them carefully.
By registering to use this service You acknowledge that You have read and understood these Terms of Service; and are authorised to act as a representative of the entity accessing this Service; and agree that Yourself and all other representatives of the entity who access this Service are bound by them. These Terms of Service are binding from the time that T&D provides You with access to this Service.
Dailys provides a time-recording software service to their clients. Using Dailys, You can store and collate records of Your staff activities and expenses and use this information to bill clients, complete payroll tasks and manage projects.
Unless either party has the written consent of the other, each will preserve the confidentiality of all Confidential Information obtained in connection with the terms of this Agreement.

Dailys is protected by copyright and/or other applicable law. Any use of the Software other than as authorised under these Terms of Service is prohibited.
Dailys will remain the copyright owner of the underlying technologies and source code except those supplied by third-parties. Dailys will reserve the sole rights to redistribute and resell the technologies and source codes employed in the Software.
Data entered by the Subscriber into the website remains the property of the Subscriber, however access to the data is contingent upon full payment of Fees to Dailys by the due date.
Provided you do not breach our Term of Service, T&D grants You a monthly non-exclusive, non-transferable right to use and access the Dailys service according to Your subscription type. As the Subscriber, You determine who else may access the Service on Your behalf as an Authorised User, in accordance with the terms of Your subscriptions. You are responsible for your Authorised Users use of the software including their level of access and permissions.
You are able to revoke or amend the access of an Authorised User at any time.
If there is any dispute between the Subscriber and an Authorised User regarding access to the Software, the Subscriber shall decide what access or level of access to the relevant data that Authorised User shall have, if any.
You must ensure that all usernames and passwords required to access the Software are kept secure and confidential and notify T&D immediately of any unauthorised use of passwords or any other breach of security.
You must not input to the Website any files that may damage any other person’s devices or software, offensive content or material (including copyrighted material) in violation of the Law. You must not use the service for any unlawful purpose or illegal activity.
You must not attempt to undermine the security of Dailys systems or networks; use or misuse the Service in any way that undermines the functionality of the Software; or impair the ability of any other user to access the Service.
You must not attempt to gain unauthorised access to any materials other than those You have express permission to access.
You must not attempt to modify, copy, adapt, reproduce or re-engineer any computer programs used to deliver this system other than what is required for normal operation.
Once signed up to access Dailys, You can evaluate Dailys under the Terms of Service, with no obligation to continue to use the service. If you choose to continue using the Service thereafter, You will be billed from the day after the trial period, for the month in advance. If you choose not to continue using the service, you can at any time discontinue your service in the ‘Billing’ section.
An invoice for the Fee will be issued each month. All invoices will include the Fee for the forthcoming period of use and be payable within 14 days of the invoice date. Dailys will continue to invoice the Subscriber monthly until this Agreement is terminated.
The invoice will be sent to the Subscriber or a billing contact whose details are provided in writing by the Subscriber.
Dailys reserves the right to suspend or terminate Your access to this Service in the event that invoices for Fees are not paid in full by the due date for payment.
This Agreement will remain in place until it is terminated by You, or by Dailys, at the conclusion of any minimum monthly subscription period determined in the Subscription Type.
Dailys provides no guarantee that your data can be recovered once your account is cancelled. Dailys are not liable for any loss or damage following, or as a result of, cancellation of your account, and it is your responsibility to ensure that any content or data which you require is backed-up or replicated prior to cancellation.
Dailys endeavour to provide a 24/7 Service, however there are occasions that will necessitate service maintenance. Dailys do everything possible to minimise and avoid downtime during this maintenance.
If for any reason Dailys has to interrupt the Service for an extended period, Dailys will endeavour to notify You in advance with details of maintenance and expected timeframes.
To the maximum extent permitted by law, Dailys excludes all liability and responsibility to the Subscriber, tort (including negligence), or otherwise, for any loss (including loss of information, data and profits) or damage resulting, directly or indirectly, from any use of, or reliance on, the Software or Website.
If You suffer loss or damage as a result of T&D’s negligence or failure to comply with these terms, any claim by You against T&D arising from T&D’s negligence or failure will be limited in respect of any one incident, or series of connected incidents, to the Access Fees paid by You in the previous month.
To keep abreast of changing technologies and ensure ongoing product development, Dailys reserves the right to perform software updates and amend our terms of service at any time. Dailys will make every effort to communicate any major changes or software upgrades to you. Your continued use of Dailys service will be deemed to be acceptance of any amendments.
